Terms of Service

These Terms of Service (“Terms”) are an agreement between you and HostRails (“HostRails,” “we,” “us”) governing your use of hostrails.com and our services, including website design, managed WordPress hosting, and related tools. By using the service, you agree to these Terms and to our Privacy Policy.

HostRails builds, hosts, and manages WordPress websites for businesses. We handle infrastructure, updates, backups, and security so you can focus on your business. Specific features depend on your plan. We may improve or modify the service over time.

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 18 and authorized to act for the business you register.

Paid plans are billed in advance on a recurring basis via our payment processor. Trials, discounts, and one-time services are as described at checkout. You can cancel any time; cancellation stops future renewals and your service remains active through the end of the paid period. Except where required by law, fees are non-refundable.

You own the content you provide (text, images, business information). You grant us a license to host, display, and process it solely to provide the service. You are responsible for having the rights to the content you provide and for its accuracy and legality.

You agree not to use the service to:

• violate any law or the rights of others;
• distribute malware, spam, or deceptive content;
• host content that is unlawful, infringing, or fraudulent;
• attempt to disrupt or gain unauthorized access to our systems or other customers’ sites.

We may suspend or terminate accounts that violate these rules.

HostRails offers a text messaging program for account notifications (for example: website build updates, review requests, and appointment reminders) and, with separate consent, marketing messages. You enroll by opting in — for example through our text message sign-up form — and consent to marketing texts is never a condition of purchase.

• Message frequency varies based on your account activity and preferences.
• Message and data rates may apply, depending on your mobile plan.
• Reply STOP at any time to unsubscribe — you’ll receive one final confirmation message. Reply HELP for help, or contact hello@hostrails.com.
• Wireless carriers are not liable for delayed or undelivered messages.

Our SMS privacy practices — including that mobile information is never shared with third parties or affiliates for marketing — are described in the Privacy Policy.

The service is provided “as is.” While we work hard to keep sites fast, secure, and online, we do not guarantee uninterrupted or error-free operation and are not responsible for outcomes such as search rankings, lead volume, or revenue.

To the maximum extent permitted by law, HostRails will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

You may cancel at any time from your dashboard or by contacting us. We may suspend or terminate the service for breach of these Terms. Upon termination we will, on request within 30 days, provide a reasonable export of your website content.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California.

We may update these Terms from time to time. Material changes will be posted here with a new effective date; continued use after changes take effect constitutes acceptance.
